Greg Murphy, Representative of North Carolina, announced his bipartisan bill aimed at enhancing the enforcement of the No Surprises Act and ensuring patients are protected from unexpected medical bills. The statement was made on X.
“The No Surprises Act was signed into law to eliminate surprise medical billing, but it’s not being enforced as Congress intended,” said Gregory Francis Murphy, U.S. Representative for North Carolina’s 3rd congressional District (R). “I introduced the bipartisan No Surprises Enforcement Act to crack down on insurers defying the law. We must put American patients first.”
The No Surprises Act, which was implemented in 2022 to protect patients from unforeseen out-of-network medical expenses, is still encountering enforcement challenges. According to Kaiser Health News, disputes between providers and insurers over payment rates have led to significant arbitration backlogs. Both patient advocates and industry groups are urging regulators to provide clearer guidance and improve enforcement for more consistent consumer protection.
A 2024 report by the Centers for Medicare & Medicaid Services indicates that the incidence of surprise medical bills decreased by 80% following the implementation of the No Surprises Act. However, over 21,000 complaints were filed in 2023, mostly concerning emergency and air ambulance care.
A 2024 analysis by the Government Accountability Office reveals that insurer compliance rates with the No Surprises Act average 92% nationwide. Nonetheless, more than 600 enforcement actions have been necessary, primarily due to delayed payments or improper billing disclosures.
