The new bill filed by State Rep. Keith Kidwell seeks to amend North Carolina’s constitution to broaden legal weapon carry rights for eligible citizens, according to the North Carolina State House.

The bill, filed as HB 1108 on April 29 during the 2025 regular session, was formally listed with the short title: ‘Const. Amend./Permitless Carry.’

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill proposes a North Carolina constitutional amendment that would grant any U.S. citizen who has not been indicted or convicted of a violent crime or certain drug offenses and not been found mentally incompetent the right to carry any legal weapon for self-defense, openly or concealed, with or without a permit, except where property is legally posted against it. It would keep a permit system for reciprocity with other states and firearm purchases but bar requiring a permit for concealed carry by law-abiding citizens. The amendment would appear on the Nov. 3, 2026, general election ballot and take effect upon certification if approved by voters.

A related bill, SB 815, was also filed in the North Carolina Senate, introduced by Sen. Timothy D. Moffitt (and two others) on April 21, 2026.

Of the four sponsors of this bill, Kidwell proposed the most bills (32) during the 2025 regular session.

Bills in North Carolina follow a multi-step process before becoming law. A lawmaker starts by filing a bill, which is assigned to a committee for review. The bill must be read three times in each chamber. If one chamber changes the bill after the other passes it, both must agree on the final version.
