The North Carolina State House passed House Bill 10, which would require local sheriffs to comply with ICE, on September 11.
The bill was approved by the Senate in a vote on September 9. The legislation has been sent to Governor Roy Cooper for his approval.
North Carolina House Bill 10 would “require that Immigration and Customs Enforcement of the United States Department of Homeland Security (ICE) be queried when an individual charged with certain offenses is in custody and that person’s legal residency or United States citizenship status is undetermined,” as well as require a judicial order for the prisoner to be detained for up to 48 hours or until the request is resolved by ICE.
The bill passed in the Senate 27-17, with 6 abstaining. The bill passed in the House 67-43, with 8 abstaining.
“North Carolina is dealing with border issues right now,” Republican Speaker of the House Tim Moore said about the bill. “We’re dealing with thousands of people who are in this state who shouldn’t be here. And we’re dealing with folks who shouldn’t be here and committing serious crimes.”
The bill also includes a section on a school choice voucher program, setting aside an additional $463 million for the program during the current school year and next school year.
